Refund on engagement ring?

I got a custom made engagement ring, i only had it less than 1 week and the main stone came loose so i took it back to the jeweller to get it tightened, i just got it back yesterday and now the main stone has become so loose it has fallen out of the setting. This ring has cost almost $2,500. So what’s my chances of actually being able to get a refund for it?
yes it is insured but it’s got nothing to do with insurance, the jeweller didn’t make it properly, it’s dodgy work which i shouldn’t have to make an insurance claim for
a refund is apart of the fair trading act, their work wasn’t up to standard, there for i shouldn’t have to be stuck with a bad ring

Get them to tighten it again, free!

If they refuse you should inform them that as you paid for the ring and it does not do what it is meant to do you require a replacement (same ring made all over again) or a refund. (you can get a refund if an item does not do what it is meant to do and thay cannot replace it with a comparative item. As this was a specific design it would have to be the same item. Either a new ring or a refund. This is in the fair trading act!)

If they do not agree to that (take the ring with you) call fair trading and explain the situation. Make note of what they say, who you are talking to and when time and date.

Write a letter to the jeweller detailing the date you made the order, when you picked it up, how much you paid, when it first broke, when it was fixed and when it broke again. you might like to include a copy of the design and the specifications of the diamond (4c’s and dimentions) and details from fair trading.
State what you would like them to do about the broken ring.
Give them a deadline (a week or 2) to respond to your letter with either a refund or same value replacement. Tell them that if they do not respond by this time you will proceed with legal action. Keep a few copies of this letter for yourself.

Hopefully they agree to fix it permanently straight away!
